Welcome to Punch Monkey. These Terms and Conditions (“Agreement”) govern the purchase and operation of a Punch Monkey frozen banana franchise within the Kingdom of Thailand. By purchasing a franchise, you (“Franchise Partner”) agree to comply fully with the terms outlined below.
1. Product Pricing Policy
All Franchise Partners must adhere strictly to the official pricing set by Punch Monkey:
● The retail price of the standard finished product (chocolate-dipped frozen banana) must be fixed at 69 Thai Baht (THB).
● Unauthorized price changes, discounts, or bundling that affect the standard price are not permitted without prior written approval.
2. Approved Ingredients and Supply Chain
To maintain product quality and brand consistency:
● Franchise Partners are required to purchase all ingredients and materials exclusively from Punch Monkey’s officially approved suppliers.
● Access to authorized supplier links (Shopee stores) will be provided upon franchise onboarding.
3. Supply Shortage and Support
In the event that official suppliers are unable to fulfill orders:
● Franchise Partners must immediately contact Punch Monkey’s support team.
● Support is available via:

● Punch Monkey support team will assist in providing alternative sourcing solutions where applicable.
4. Franchise Scope and Location Restrictions
● Each franchise purchase grants the right to operate only one (1) outlet at a designated location within Thailand.
● Franchise Partners are strictly prohibited from:
a. Replicating, sublicensing, or expanding the franchise independently.
b. Operating multiple locations under the Punch Monkey brand without written authorization.
5. Intellectual Property Rights
● Punch Monkey is a registered trademark protected under Thai intellectual property laws.
● Any unauthorized use of the brand name, logo, identity, or business model constitutes an infringement and is subject to legal penalties under applicable laws, including those enforced by the Department of Intellectual Property, Thailand.
6. Brand Integrity and Product Quality
● Franchise Partners must maintain the quality standards defined by Punch Monkey.
● The company shall not be held liable for:
a. Any misuse of the brand name.
b. The sale of substandard or altered products under the Punch Monkey identity.
7. Unauthorized Use and Legal Enforcement
● Any misuse, misrepresentation, or unauthorized commercial use of the Punch Monkey brand will result in:
a. Immediate legal action in accordance with the laws of the Kingdom of Thailand.
● Punch Monkey reserves the right to pursue civil and/or criminal remedies where applicable.
8. Support and Assistance
Punch Monkey provides ongoing support to Franchise Partners, including operational guidance and issue resolution.

9. Limitation of Liability
● Punch Monkey shall not be held liable for damages, losses, or claims arising from:
a. Unauthorized use of its brand or intellectual property.
b. Actions taken by Franchise Partners outside the scope of this Agreement.
10. Termination of Franchise
Punch Monkey reserves the right to terminate the franchise agreement under the following conditions:
● Violation of any terms outlined in this Agreement.
● Misuse of brand identity or intellectual property.
● Failure to comply with operational or quality standards.
Upon termination:
● The Franchise Partner must immediately cease all operations under the Punch Monkey brand.
● No refunds shall be issued under any circumstances.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Thailand. Punch Monkey operates in full compliance with Thai legal and regulatory frameworks, and all Franchise Partners are expected to do the same.
12. Amendments
Punch Monkey reserves the right to update or modify these Terms and Conditions at any time. Continued operation of the franchise constitutes acceptance of any revised terms.
